By accessing or using Remarkbox ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. Remarkbox reserves the right to update these terms at any time; continued use of the Service constitutes acceptance of any changes.
Remarkbox is a hosted comment system that website owners ("Customers" or "Namespace Owners") embed on their sites to enable discussions. Users ("Commenters") participate by posting comments. Remarkbox also provides a JSON API for programmatic access and a standalone site mode for discussion forums.
To post comments, you must verify your email address using a one-time password (OTP) code, or post anonymously where allowed by the namespace owner. You are responsible for maintaining the security of your email account and any session cookies stored by Remarkbox. You agree not to share your session or impersonate others.
You retain ownership of the content you post on Remarkbox. By posting content, you grant Remarkbox a non-exclusive, worldwide license to store, display, and distribute your content as part of the Service. You are solely responsible for the content you post and represent that it does not violate any applicable law or third-party rights.
You agree not to use the Service to:
Remarkbox uses automated systems to detect and manage spam. This includes content scoring algorithms and machine learning-based relevance checking (powered by Hermes, a third-party machine learning inference service operated by UncloseAI). Comment content and thread context may be sent to the machine learning service for analysis when this feature is enabled by the namespace owner.
Content flagged by the automated system may be held for moderator review, labeled as spam, or rejected. Namespace owners and moderators can override automated decisions. Namespace owners may disable machine learning-based moderation for their namespace at any time.
Remarkbox stores spam scores and machine learning explanations alongside comments to support moderation transparency.
The Remarkbox API and service enforce rate limits to prevent abuse. These currently include limits on read requests, write requests, and new thread creation. Exceeding these limits will result in temporary throttling (HTTP 429 responses). Rate limits are subject to change.
Namespace owners and their designated moderators have the ability to approve, disable, or delete comments within their namespace. Remarkbox may also employ global moderators ("superusers") who can moderate content across all namespaces to address spam and abuse at the platform level.
Remarkbox reserves the right to remove content or disable accounts that violate these Terms of Service, with or without notice.
Remarkbox provides a JSON API for programmatic access. Use of the API is subject to rate limits and these Terms of Service. Namespace owners may enable or disable API access to their namespace via namespace settings. Misuse of the API, including circumventing rate limits or automated mass posting, may result in account suspension.
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and share your personal data, including the use of machine learning-based content analysis.
You may export your personal data or permanently delete your account at any time via your user settings page. Account deletion removes your personal data from the Service in accordance with our Privacy Policy.
Remarkbox aims to provide a reliable service but does not guarantee uninterrupted availability. The Service is provided "as is" and "as available." Remarkbox is not liable for any downtime, data loss, or damages arising from use of the Service.
To the maximum extent permitted by law, Remarkbox and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, or profits, arising from your use of the Service.
These Terms of Service are governed by the laws of the State of Connecticut, United States, without regard to conflict of law principles.
